TERMS AND CONDITIONS OF CARRIAGE
Agreement to Terms By giving us your shipment, you agree, regardless of whether you sign of this Express waybill for yourself or as an agent for and on behalf of any other person having an interest in this shipment, to all terms on this NON-NEGOTIABLE Express waybill, and as appropriate to all terms in any C & N Express Limited agreement between you and C & N Express Limited covering this shipment, and in any applicable tariff, and in our current Standard Conditions of Carriage, copies are available upon request. Your Obligations You warrant that each article in the shipment is properly described on this Express Waybill and any export documents, acceptable for transport by us, and properly marked, addressed, and packed to ensure safe transportation with ordinary care in handling. You are responsible for all charges including transportation charges, and possible surcharges, customs and duties assessments including fees related to our prepayments of the same, governmental penalties assessments and fines, taxes, and our lawyers’ fees and legal costs, related to this shipment. Prohibited Items You agree not giving us for delivery any item which is illegal, explosive, dangerous or destructive to send Event outside our control We are not required to provide our services, or carry out any of our obligations referred to in these terms, if it is not reasonably practical for us to do so because of an event outside our control. Includes any delay in acceptance of an item by an addressee; our inability to gain access to a delivery address; seizure or destruction of an item by customs or any other regulatory or government authority; an act of God; earthquake, volcanic activity, flood, fire, storm or adverse weather condition; sabotage, riot, civil disturbance, epidemic, national emergency or act of war; governmental action; strike, lock-out, work stoppage or other industrial problem; traffic congestion; or delay in aircraft or other transport. “item” means any packet, parcel, document, article Return of Items If you have indicated that you wish your item to be returned to you in the event if non-delivery your package, which will constitute the return of the postal article to you for the purpose of the Postal Service Act 1998.Your package will be returned to you provided, you pay the full cost of return, this cost may exceed the original fees you paid. If you refuse to pay the return costs for your package or cannot be contacted by us after reasonable period of time, you agree that we may dispose of your returned package in whatever manner we deem fit. We reserve that right to recover the cost incurred. Weight We may reweight your item at any time to confirm the chargeable weight, may charge according to the actual or volumetric weight of your item. Customs Duties
The receiver is responsible for payment of any customs duty ( or other regulatory charges) made by customs authorities in the destination country. In the event of non-payable by receiver, the sender will be responsible for any duties, taxes and government charges associated with the shipment. Insurance Insurance service is provided for all international packages, depending on your intention. The insured amount is based on the actual value of contents. The maximum insured amount is fixed up to NZD$500. Sender is request to pay the insurance fee accordingly. For the items which have not purchased insurance in the event of loss or damage of items, the highest amount of compensation up to NZD$200 maximum.
Definitions The following definations apply to the items and conditions set out below that governs this contract of carriage between you and us, “We” “Us” and “our” means subsidiaries, affiliates of C & N Express Limited, and their respective employees, agents; Means the sender consider consignor or consignee of the shipments, holder of this consignment note, receiver and owner of contents of the shipment or any other party having a legal interest in those contents; “Carriage” means and includes the whole of the operations and services undertaken by us in connection with the shipment “Shipment” means any document, envelope, packages, parcel, satchel or piece of freight given and accepted by us for carriage and transported under our consignment note; “Prohibited items” means any goods or materials the carriage of which is prohibited by any law, rule or regulation of any country in which the shipment travels.
